4.1 The App can be used to book individual Services or to take out a paid membership with a specific scope of Services.
4.2 The individual availability of the Services and the respective Service details are displayed in the App. The contract for the booked Service is concluded directly with the respective Provider. The presentation of the available Services in the App does not constitute a legally binding offer.
4.3 If a User books a specific Service from a Provider by clicking on the “Order and pay” button for fee-based services and the “Order” button for free services, the User submits a binding offer to the Provider to book the Service shown in the booking overview (“Booking Offer”). The contract for the booked Service is concluded when a corresponding confirmation message is displayed in the App. In addition, Snapdesks sends a confirmation email with the details of the booked Service to the email address provided by the User. If a Service is offered for booking by a Provider outside of the App, the individually agreed terms and conditions shall apply accordingly.
4.4 Memberships for consumers
(a) Consumers are required to take out a paid membership to book, for example, a dedicated workstation (e.g. in an open workstation area or an open-plan office or access to a lobby) with a Provider on a daily and/or hourly basis. Consumers can choose from various memberships, the exact scope and duration of which are displayed in the App immediately before a membership is concluded. By clicking on the “Subscribe and pay” button, the consumer submits an offer to conclude a contract. A membership contract is concluded with Snapdesks by displaying a confirmation message in the App. At this point, the membership fee is due, and the specified payment method is debited accordingly by Snapdesks or its payment service provider. In addition, Snapdesks will send a confirmation email with the details of the booked membership to the email address provided by the consumer.
(b) For consumers, the statutory right of cancellation according to section 14 of the GTC applies.
(c) The minimum term of the membership is determined by the conditions displayed in the App at the time the contract is concluded. Upon expiry of the minimum term, the membership will automatically renew for successive one-month periods unless terminated with one month’s notice effective at the end of the initial term or any renewal period. The minimum term and each subsequent renewal period are collectively referred to as a “Membership Cycle”.
(d) The amount of the respective monthly membership fee is displayed to the consumer in the App before a membership is concluded.
(e) The designated payment method will be debited immediately for the first month’s membership fee upon conclusion of the membership. The same payment method will be charged on the corresponding calendar date in each subsequent Membership Cycle (e.g., if the membership starts on 3 April, the fee will be charged on the 3rd of each following month). If this date does not exist in a given month, the charge will occur on the next business day.
(f) If, for any reason, Snapdesks or its payment service provider is unable to debit the membership fee, the debit will be attempted again as soon as practically possible. It is mandatory for the User to provide a current and valid payment method accepted by Snapdesks. If it is not possible to collect the membership fee based on the payment method on file and the User does not provide another accepted and valid payment method within 14 calendar days, Snapdesks is entitled to terminate the membership without notice. Snapdesks is also entitled to terminate the membership without notice if the consumer violates the GTC, in particular by misusing bookable Services or violating ethical principles.
(g) Upon termination of membership, for whatever reason, the consumer loses access to the Services covered by the membership. The consumer may continue to use the App without a membership, subject to other provisions of these GTC (e.g., when booking individual Services).
(h) Snapdesks may occasionally offer consumers to begin their membership with a free trial. This may consist of one or more free Membership Cycles directly following the conclusion of the membership. The duration and scope of any such trial period will be displayed in the App immediately prior to concluding a membership that includes a trial period. Any trial period does not affect the agreed minimum term for memberships for consumers. Upon expiry of the trial period, the membership automatically converts into a regular paid membership at the agreed membership fee. Accordingly, consumers must provide a valid payment method accepted by Snapdesks at the time of entering into a membership that includes a free trial. Trial periods may be subject to additional conditions and restrictions imposed by Snapdesks. Unless otherwise stated, trial periods are non-transferable, cannot be combined with other offers or redeemed for real value and are generally available only once per consumer. If we determine immediately or subsequently that the aforementioned conditions are not met with regard to a consumer who has concluded a membership with a trial period, we reserve the right to cancel the membership with immediate effect or to deny the trial membership altogether.
4.5 Users of corporate memberships
(a) Snapdesks offers corporate memberships to Businesses (“Corporate Memberships”). The consumer memberships displayed in the App are not available to Businesses. Corporate Memberships are subject to a separate business membership agreement, which Businesses enter directly and individually with Snapdesks.
(b) Corporate Memberships authorize a number of Users agreed between the Business and Snapdesks to book Services in accordance with the individually agreed terms and conditions. Such Users may only be the Business’ own employees (employees, persons similar to employees, trainees). If such a User loses the aforementioned status, their authorization to use the Services of the Corporate Membership ends at this point in time. Such Users are free to use the App in another way, for example by taking out a consumer membership.
(c) Users who use Services as part of a Corporate Membership are also free to use the App in other ways. For example, by taking out an additional membership for consumers or by booking individual Services.
4.6 Booking individual Services from Snapdesks as a Provider
(a) The booking of certain Services via the App, which are provided by Snapdesks as a Provider, is subject to a fee (e.g. the booking of a meeting room operated by Snapdesks on a daily or hourly basis). The exact scope of Services, the Service duration and the Service period are displayed for the User in the App immediately before submitting the booking offer. By clicking on the “Order and pay” button, the User submits a binding offer to Snapdesks to conclude a contract. A contract for the Service is concluded with Snapdesks by displaying a confirmation message in the App. At this time, the booking fee is due, and the deposited payment method will be debited with the corresponding amount from Snapdesks or its payment service provider no later than 7 calendar days before check-in. If the booking is made less than 7 calendar days before check-in, the invoice amount is due for payment immediately. In addition, Snapdesks will send a confirmation email with the details of the booked Service to the email address provided by the User.
(b) The User has no entitlement to change, reschedule, or otherwise rebook Services once booked. However, depending on the availability of Services, bookings (including booked technology, catering, etc.) can be rebooked up to 7 calendar days before the original service period without additional fees. Depending on the alternative Service selected, additional booking fees may be incurred (e.g. different service location, different scope of Service).
(c) Users may cancel booked Services (including technology, catering, etc.) prior to the start of the service period by notifying Snapdesks in writing (e.g., via email to sales@thisisatworld.com). Snapdesks is entitled to flat-rate compensation based on the time between the cancellation and the scheduled service period, as follows: If a User cancels at least 14 calendar days before the service period, Snapdesks will receive compensation equal to 25% of the booking fee. If a User cancels between 7 and 13 calendar days before the service period, Snapdesks will receive compensation equal to 50% of the booking fee. If a User cancels less than 7 calendar days before the service period or if Snapdesks is entitled to cancel during this period, Snapdesks will receive the full booking fee as compensation.
(d) The statutory right of cancellation for consumers pursuant to section 14 of the GTC remains unaffected by the above provisions.
(e) It is mandatory for the User to provide a current and valid payment method accepted by Snapdesks. Payment of the booking fee is due no later than 7 calendar days before the start of the service period. A utilization of the booked Service is only possible if payment is received on time. If the booking fee cannot be collected via the deposited payment method, the User is obliged to deposit an alternative, valid payment method that enables collection by the day of the booked Service at the latest. If payment is not made in due time, Snapdesks is entitled to cancel the booked Service. In this case, Snapdesks’ right to payment of the relevant cancellation fee pursuant to section (c) of this clause shall remain unaffected.
(f) Special provisions for Teamspaces: If Snapdesks offers so-called Teamspaces as an individual Service via the App, their exact scope of Services is specified in the App. Teamspaces are only available for bookings for commercial or (self-employed) professional purposes. Users are responsible for the behavior of their guests or employees who make use of a booked Teamspace. When using Teamspaces, appropriate consideration must be shown with the aim of avoiding disruption to other users of the building. Subject to any other mandatory statutory provisions, Users are fully liable for any damage caused by themselves, guests or employees in connection with the use of a Teamspace.
